1) Scope

1.1
These General Terms and Conditions of jp60 apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter referred to as the "customer") and the seller concerning the goods presented in the seller’s online shop. The inclusion of the customer’s own terms and conditions is hereby rejected unless otherwise agreed.

A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.  

An entrepreneur within the meaning of these Terms and Conditions is a natural or legal person or a legally recognized partnership that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.


2) Conclusion of Contract

2.1
The product descriptions in the seller’s online shop do not constitute binding offers from the seller but serve as an invitation for the customer to submit a binding offer.

2.2
The customer can submit an offer via the online order form integrated into the seller’s online shop. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer for the goods in the shopping cart by clicking the final order button. Additionally, the customer can also submit an offer to the seller via email or through the online contact form.

The seller may accept the customer’s offer within five days by sending the customer a written order confirmation or an order confirmation in text form (e.g., email), with the receipt of the order confirmation by the customer being decisive, or by delivering the ordered goods to the customer, with the receipt of the goods by the customer being decisive, or by requesting payment from the customer after the customer has placed their order. If several of the aforementioned alternatives occur, the contract is concluded at the moment the first of the alternatives occurs. The acceptance period begins the day after the customer submits their offer and ends at the end of the fifth day following the submission of the offer. If the seller does not accept the customer’s offer within the aforementioned period, this is considered a rejection of the offer, meaning the customer is no longer bound by their declaration of intent.

When submitting an offer via the seller's online order form, the contract text will be stored by the seller after the conclusion of the contract and sent to the customer in text form (email) after the customer has submitted their order. No further access to the contract text will be provided by the seller. If the customer has created a user account in the seller's online shop before submitting their order, the order data will be archived on the seller's website and can be accessed by the customer through their password-protected user account using the corresponding login details, free of charge.

2.5
Before placing a binding order via the seller's online order form, the customer can identify any input errors by carefully reading the information displayed on the screen. A useful technical tool to better detect input errors may be the browser's zoom function, which enlarges the display on the screen. The customer can correct their entries during the electronic ordering process using the usual keyboard and mouse functions until they click the final order button.

The contract can be concluded in English.

Order processing and communication generally take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct, so that emails sent by the seller can be received. In particular, the customer must ensure that any spam filters used allow all emails sent by the seller or third parties engaged by the seller for order processing to be delivered.


3) Right of Withdrawal

3.1
Consumers are generally entitled to a right of withdrawal. Withdrawal Instruction & Withdrawal Form Consumers are entitled to a right of withdrawal under the following conditions, where a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity.

Please return the items in their original condition. Your items must be returned new, with packaging, including the completed delivery note. We would like to point out that your packages must be returned to us with a tracking number. Additionally, we reserve the right to cancel orders/items if the ordered items are no longer in stock.

3.2 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last item.

To exercise your right of withdrawal, you must inform us (jp60, Wuerzburger Str. 32, 97228 Rottendorf, info@jp60.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.


3.3 Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you (excluding any incurred shipping costs) without delay and no later than fourteen days from the day we receive your notice of withdrawal.

We will use the same payment method that you used for the original transaction unless expressly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the returned goods or until you have provided proof that you have shipped the goods back, whichever occurs first.

You must return or hand over the goods to us without delay and no later than fourteen days from the day you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct costs of returning the goods. You are only responsible for any loss in value of the goods if this loss results from handling that was not necessary to examine the nature, characteristics, and functionality of the goods.


4) Prices and Payment Terms

4.1
Unless otherwise stated in the seller’s product description, the prices listed are total prices. Any additional delivery and shipping costs will be specified separately in the respective product description.

4.2
The available payment methods will be communicated to the customer in the seller’s online shop.

4.3
If advance payment by bank transfer has been agreed upon, the payment is due immediately after the conclusion of the contract, unless the parties have agreed on a later due date.

4.4
If payment is made using a payment method offered by PayPal, the transaction is processed through the payment service provider PayPal (Europe) S.À R.L. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as "PayPal"), in accordance with PayPal’s terms of use, available at: https://www.paypal.com/de/legalhub/paypal/useragreement-full.

If the customer does not have a PayPal account, the payment is processed under the Terms for Payments without a PayPal Account, available at: https://www.paypal.com/de/legalhub/paypal/privacy-full.

4.5
If payment is made using a payment method offered by Sofortüberweisung, the transaction is processed through the payment service provider Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (hereinafter referred to as "Sofort"), in accordance with Klarna’s terms of use, available at: https://www.klarna.com/de/agb/.


5. Delivery and Shipping Terms

5.1 
The delivery of goods is carried out via shipping to the delivery address specified by the customer unless otherwise agreed. The delivery address provided in the seller's order processing system is decisive for handling the transaction.

5.2 
If the shipping company returns the dispatched goods to the seller because delivery to the customer was not possible, the customer shall bear the costs of the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstances that led to the failed delivery or if they were temporarily prevented from accepting the offered service, provided that the seller had not announced the delivery within a reasonable period in advance. Additionally, this does not apply to the initial shipping costs if the customer validly exercises their right of withdrawal. In the case of a valid withdrawal, the provisions stated in the seller’s cancellation policy apply to return shipping costs.

5.3 
Self-collection is not possible for logistical reasons.

Unless otherwise specified in the quote, domestic delivery of goods shall be made (Germany) within 2 - 4 working days, for deliveries abroad within 2 - 8 working days from conclusion of contract (if advance payment agreed from the date of the payment instruction).
Please note that deliveries are not made on Sundays and other holidays.

5.5 
If you have ordered articles with different delivery dates, we send the articles together in one delivery if no other agreement has been made. The delivery date for the complete order will be the same as that of the article with the longest delivery time.

5.6 
Shipping to German and foreign islands is excluded.


6) Retention of Title

If the seller provides goods in advance, ownership of the delivered goods remains with the seller until full payment of the purchase price has been made.


7) Liability for Defects (Warranty)

7.1
If the purchased item is defective, the provisions of statutory liability for defects apply.

7.2
In the case of a defective delivery, please contact our customer service/support at info@jp60.de. If the goods are defective, we will provide a return label for the return shipment and will promptly rectify the issue upon receiving the defective goods. If the return shipment is made at the customer’s own expense, we will only cover shipping costs up to a maximum amount of €4.99.

7.3
Customers are encouraged to report any obvious transport damages to the delivery provider and inform the seller accordingly. Failure to do so does not affect the customer’s statutory or contractual warranty rights.

 

8) Applicable Law

All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the provisions of international sales law on movable goods.
For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.


9) Alternative Dispute Resolution

9.1
The EU Commission provides an online dispute resolution (ODR) platform, accessible at the following link:

This platform serves as a contact point for the out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.

9.2
The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board but is generally willing to do so.
